previously 7 reminders have been sent to them & they have never replied & keep sending penalty letters & refuse to give possession & copy of all documents demanded by us , failure to comply their duties as a builders & defective sale case is there & cheating the consumers by not clearly stating facts & misguiding us with false claims

Subject :- gaurav excellency Flat no 0104 Bldg 3 Follow ups for last 5 years NOW !!
with reference to your letter sent to us on 9.12.13 via courier on the completion of your project along with a demand notice for outstandings , we would like to clarify & ask you to furnish all facts & documents to the same to settle your balance amount if any & agree to take possession subject to below terms , conditions & queries are dealt , answered & agreed upon with us in a professional & business way of dealing with clients :-
1. Our previous emails : Have till date not been answered by your office since last 2 years now , we have been calling up & pursuing your office for the completion certifcates for last 2 years now as your letter dated 1.12.2011 stated that you would be completing all works in 90 -120 days which was never done . See emails of 6.3.2013, 4.4.13,2.7.13 & today .
2. Our meeting at your office in the months of march/ april/may 2013 where in we met Mr terence , mr Nimish, mr kadam & finally your director Mr Jayeshbhai shah too & agreed to pay all dues except last possession instalment & development charges , same was agreed by both your staff that we would pay only when you physically show us a copy of the completion certificate & we shall take possession only then. We paid all dues at this time via receipt nos :-
1. BED49552 - amount : 177960, date :- 7.5.2013
2. PRA49350 - amount : 23588 date :- 19.4.2013.
3. Pra43024 - amount : 7740 date :- 29.3.2013
All receipts are in record with us showing clearly our intention to pay in time since last 6 years of this project since we paid 80% of the amount in the year 2008& have been making regular payments to you . We also got the stamp duty & registration done 2 years back with the commitment from your end that you would finish the project in 2011 , but still not done .
3. CC letter :- you have stapled additional paper , which is not your letter head , nor signed by the directors or authorised signatories , nor dated , nor computer generated paper letterprint , which claims you have obtained the CC for the building no 3 in your project gaurav excellency , if that is the case , you should have attached a copy of the CC & sent it to us along with a covering letter from your architect & signed by a authorised signatory , which is not done , may we ask why ?
Assuming your claim to be True , may we ask you now to send us a copy of the Completion certificate by email or courier to our address & fix up the meeting at your office to clear all the issues amicably ,
4. Docs required by us Please send asap :-
a. Occupational Certificate from the Mira Bhayender MC : Which you said might take 6 months more at this time.
b. Water & electrical Connection Certifcate & presence of Indivdual water/electric meters connected to our apartments .
c. Health club & other amenities :- that you want us to pay , please ask your architect to issue a certificate that these amenities are ready to use for us to make the payment to you as per OC clause all amenities should be ready to use & certified by Municipal Corporations engineers.
d. Fire,Lift safety NOC & completion certificate since its a tower project , along with approved plan of the refuge areas & assemble areas.
e. Final copy of the approval of the BCC & CC for the bldg upto level 16 as per ur claims
To summarise my email & concerns on the unsigned letter dated 8.5.14 you have sent me for penalty & payments , suggest that you reply to this email of mine & we can arrange a meeting personally if you are ready to give us all clearances & papers that we seek as this is our legal right to ask the developers for the same , failure to submit the same to us will be counted as a lapse/breach of agreement from your side .
please reply to this email within 7 days time , failure to reply will be counted as you are not willing to cooperate with us as buyers of the property & will leave us no option but to address the matter with MCHI & respected consumer court of India .
